GENERAL TERMS AND CONDITIONS OF SALE DOMAINE DES CLOS

  • "Customer" refers to a natural person of legal age, acting for his/her own personal needs and having full legal capacity to enter into commitments hereunder.
  • "Conditions of sale of the reserved rate" refers to the specific conditions of each reservation made by the Customer.
  • "Booking Confirmation" means the document summarizing the details of the booking made by the Customer, sent by the website or the reservations department to the Customer.
  • "Reservation Request" refers to any request made by the Customer to reserve a hotel room.
  • "Hotel" refers to the hotel Le DOMAINE DES CLOS, operated by SARL DOMANE DES CLOS with capital of 100,000 euros, whose registered office is at DOMAINE DES CLOS, 911 chemin du mas de la Tour, 30 300 Beaucaire, registered with the Nîmes Trade and Companies Register under number B402 407 589.
  • "Partners" refers to all service providers who have signed a service contract or partnership agreement with the Hotel.
  • "Service" refers to any hotel room reservation service provided by the Customer on the Hotel's website.

 

ARTICLE 1 - SCOPE OF APPLICATION : These General Terms and Conditions of Sale apply, without restriction or reservation, to all purchases of hotel room reservation services and related services ("the Services") offered by the Hotel ("the Provider" or "the Hotel") to consumers and non-professional customers ("the Customers" or "the Customer") on the Hotel's website. The main features of the Services are presented on the Hotel's website. It is the Customer's responsibility to familiarize himself/herself with them before making a reservation. The choice and purchase of a Service is the sole responsibility of the Customer.

The Customer declares : He/she has full legal capacity to enter into the present Terms and Conditions. He/she is reserving hotel rooms and related services for his/her own personal use. ARTICLE 2 - PRICES: The Services offered by the Provider are provided at the rates in force on the Hotel's website at the time the reservation is recorded by the Provider. Prices are expressed in Euros and include VAT.The rates take into account any discounts that may be granted by the Supplier under the conditions specified on the Hotel's website. These rates are closed and non-revisable during their period of validity, as indicated on the Hotel's website. The Provider reserves the right, outside this period of validity, to change prices at any time. Rates are indicated before and at the time of booking by the Customer. They are per room for the number of people and the date selected. Rates are confirmed to the Customer in the Hotel's commercial currency and include VAT (excluding tourist tax). They include VAT at the rate applicable on the day of booking; any change in the applicable VAT rate will automatically be reflected in the rates indicated on the invoice date. The same will apply to any change or introduction of new legal or regulatory taxes imposed by the competent authorities. Rates do not include tourist tax, which may be paid directly to the Hotel. The Customer undertakes to pay these various taxes to the Hotel without any dispute whatsoever. The payment requested from the Customer corresponds to the total amount of the purchase, with the exception of this Tax. Unless otherwise stated on the Site, ancillary services (breakfast, etc.) are not included in the price.

ARTICLE 3 - PAYMENT METHODS : Payment methods accepted: Carte Bleue, Visa, Mastercard, Chèque Vacances and cash. Invoices are in euros.

ARTICLE 4- RESERVATION : To confirm a booking, a deposit equivalent to 50% of the total cost of the stay must be paid D-15 before arrival, together with credit card details.The transmission of credit card details is considered to be an authorisation for direct debit. The balance of the stay must be paid on site (unless cancelled, see cancellation conditions).  Two types of tariff: flexible with defined cancellation and modification conditions, and non-cancellable, non-refundable, non-changeable with full payment on booking.

ARTICLE 5 - PROVISION OF SERVICES : The Services booked by the Customer, which include the booking of hotel rooms and holiday flats and ancillary services, will be provided in accordance with the following terms and conditions, under the conditions set out in these General Terms and Conditions of Sale supplemented by the Tariff Terms and Conditions of Sale of which the Customer is aware and which he has accepted when making his booking on the DOMAINE DES CLOS website. The Customer's personal belongings left in the hotel room or holiday flats, particularly outside the safe or in the public areas of DOMAINE DES CLOS, are the sole responsibility of the Customer.

PETS ARE NOT ALLOWED

The customer accepts and undertakes to use the accommodation with respect. Any behaviour contrary to public decency and public order will lead LE DOMAINE DES CLOS to ask the Customer to leave the establishment without any compensation or refund if payment has already been made. If no payment has yet been made, the Customer must pay the price of the nights consumed before leaving the establishment.The Customer will be held responsible for all direct and/or indirect, consequential damage caused by him/her in the room/apartment booked or which he/she may cause at DOMAINE DES CLOS. Consequently, he/she undertakes to compensate LE DOMAINE DES CLOS for the amount of the said damage, without prejudice to any damages and interest that may be due, procedural and legal costs incurred by LE DOMAINE DES CLOS. Free WIFI access enabling guests to connect to the internet is available to all guests. Rooms are available from 3 p.m. on the day of arrival and must be vacated by 11 a.m. on the day of departure. DOMAINE DES CLOS cannot be held responsible for the loss, theft, deterioration or damage caused to the said belongings. Smoking is prohibited in the rooms and non-smoking areas. Any damage to or loss of items in the room will result in a charge being made to the customer's credit card. Failure to comply with the house rules may result in expulsion without refund.

ARTICLE 6 - BOOKING CHANGES : Reservation changes are possible at no extra cost up to 5 days before the date of stay, subject to availability. Rates may vary according to the season after the change.

If the modification is not possible, the customer must respect the original reservation or comply with the cancellation conditions.

ARTICLE 7- NON-COMPLIANCE WITH CONDITIONS : Failure to comply with the conditions may result in the customer's expulsion without compensation. These general conditions define the terms of stay, payment, reservation and the rules to be followed in the establishment. Customers must read them carefully before booking a stay and take note of the cancellation conditions.

ARTICLE 8- FORGOTTEN ITEMS :Forgotten items will be kept for a maximum of one year.

 

ARTICLE 9 - CANCELLATION CONDITIONS ACCORDING TO THE PERIOD BEFORE ARRIVAL :

  • More than 15 days before arrival: No booking fee.
  • 15 days to 3 days before arrival: 50% of the total cost of the booking will be deducted.
  • Less than 3 days before arrival: 100% of the total amount of the stay will be retained as a cancellation fee.

ARTICLE 10- EARLY DEPARTURE : In the event of early departure, the remaining nights will be charged to the customer, and any stay commenced will be invoiced in full.

ARTICLE 11- NO SHOW : In the event of a no-show, the total amount of the stay will be charged as a cancellation fee. The return of items by parcel or post requires tracking and shipping costs to be paid by the customer.

ARTICLE 12- COMPLAINTS : Any dispute or complaint will only be taken into account if it is made in writing and sent by registered post to the establishment (DOMAINE DES CLOS) within a maximum of 8 days after the customer's departure.These articles describe the cancellation conditions, the associated charges, the rules in the event of early departure, in the event of no-show, and the procedures for complaints. Customers are encouraged to respect these policies and take them into account when booking.

ARTICLE 13 - APPLICABLE LAW - LANGUAGE : These General Terms and Conditions of Sale and the transactions arising from them are drawn up in French and are governed by and subject to French law. In the event that they are translated into one or more foreign languages, only the French text will be deemed authentic in the event of a dispute. Any disputes to which the purchase and sale transactions entered into pursuant to these general terms and conditions of sale may give rise, concerning their validity, interpretation, performance, termination, consequences and consequences, and which cannot be resolved between the Hotel and the Customer, shall be submitted to the competent courts under the conditions of common law - Tribunal de commerce de Nimes (Gard). The Customer is hereby informed that he/she may in any event have recourse to conventional mediation, in particular with the Commission de la médiation de la consommation (C. consom. art. L 612-1) or to any alternative dispute resolution method (conciliation, for example) in the event of a dispute.

ARTICLE 14 - PRE-CONTRACTUAL INFORMATION - CUSTOMER ACCEPTANCE : The Customer acknowledges that, prior to making a reservation and concluding the contract, he/she has been provided, in a legible and comprehensible manner, with these General Terms and Conditions of Sale and with all the information listed in article L. 221-5 of the French Consumer Code, and in particular with the following information:the essential characteristics of the Services, taking into account the communication medium used and the Service concerned ;

  • - the price of the Services and ancillary costs;
  • - in the absence of immediate performance of the contract, the date or deadline by which the Service Provider undertakes to provide the reserved Services;
  • - information relating to the identity of the Service Provider, its postal, telephone and electronic contact details, and its activities, if this is not apparent from the context,
  • - information relating to the legal and contractual guarantees and their implementation procedures;
  • - the means of payment accepted.

The fact that a natural person (or legal entity) makes a reservation on the Hotel's Internet site implies full and unreserved acceptance of these General Terms and Conditions of Sale and an obligation to pay for the Services ordered, which is expressly recognised by the Customer, who waives, in particular, the right to rely on any contradictory document that would be unenforceable against the Provider.
